Dear Sir/Madam,
We are emailing you today to inform you that with the deepest of regret and with immediate effect we have ceased trading and resolved that the company be wound up voluntarily and we would like to take this opportunity to offer our most sincere and profuse apologies. If you would please take the time to continue to read the remainder of this email as there is some important and beneficial information within. If you are owed money by us, within the next few days you will receive notice that a meeting of creditors is to be held pursuant to Section 98 of the Insolvency Act 1986. A notice of the creditors meeting will be sent to you tomorrow by email unless you advise by return that you wish to receive a hard copy.
Firstly, we would like to stress that absolutely every effort has been made to avoid this most unhappy outcome. The company has been actively seeking investment for some time but after a final meeting yesterday, the difficult decision of deciding the company’s future has been made. It is not an outcome that was given any serious consideration until recently when the threat of closing the company became very sudden and real. We would also like to stress that your order was processed in good faith and with every intention of fulfilling it to the usual outcome and so once again this decision was not taken at all lightly as we are fully aware of the circumstances this will have for our customers with orders or refunds outstanding.
Which leads us to important information that will understandably be your first concern: how do you claim your money back?
With all funds that were held by our company at the time of its closure being frozen, we advise that you contact your bank or credit card company as quickly as possible. If you paid for our products via credit card, you will be protected by the Consumer Credit Act and should contact your credit card company to make a claim in this respect. There is a similar system called chargeback for the protection for payments made via debit cards operated by Visa. When contacting them please explain that you have ordered a product online from a company that is in the process of entering liquidation and ask to begin the process of a chargeback. This process and its outcome can differ depending on the bank therefore please ask them, if you are not aware already of your entitlement and cover in this regard.
Finally, we would like to offer our most serious and profuse apologies again. We understand that this is incredibly unfortunate news for you and comes as a great shock at what will largely be considered the worst time of year for this to transpire.
