Strange answer from their “excellent” customer services.

I wrote:

Hi. Why did you take money from our account?

They answered:

Dear Customer,

thank you for your message.

We regret to inform you that a withdrawal of your order is unfortunately not possible. According to Article 8 of the Swiss Federal Act on the National Motorway Tax (NSAG), the Swiss motorway vignette is considered a legally regulated fee, not a conventional consumer product. As such, no statutory right of withdrawal applies once registration has been completed.

Information on Withdrawal:

Should you still wish to withdraw from our service, please note the following:

A withdrawal of the service component is only partially refundable if the validity of your vignette has already begun.
Upon withdrawal, all further service benefits, including customer support, will no longer be available.
You were informed about the applicable compensation for services rendered in our General Terms and Conditions (GTC), which you accepted during the ordering process. Excerpt:
“If you requested that we begin providing the service during the withdrawal period, you must pay us a reasonable amount corresponding to the portion of services already rendered up to the time of withdrawal. The calculation is based on the banking method (30 days per month / 360 days per year), in proportion to the service price and the elapsed validity period.”

Legal Note Regarding the Digital Vignette:

Please also note that we act solely as a service provider and intermediary. The contract for the toll product itself is concluded directly between you and the official Swiss toll authority (BAZG – Federal Office for Customs and Border Security).

A withdrawal of the already registered digital vignette is, under Swiss law, not possible, as it is not considered a tradable good, but rather a government-imposed toll fee. Therefore, no statutory right of withdrawal exists with respect to the BAZG.

We sincerely apologize for any inconvenience this may cause and thank you for your understanding.
